This website at voss-labs.com (the "Site") is operated by Voss Labs Ltd ("Voss Labs", "we", "us" or "our"), a company registered in England & Wales, with its registered office at 82A James Carter Road, Mildenhall, IP28 7DE, United Kingdom.
These Terms & Conditions ("Terms") govern your access to and use of the Site. Please read them carefully. By using the Site you agree to be bound by these Terms.
2. Acceptance
If you do not agree with these Terms, you must not use the Site. We may update these Terms from time to time in accordance with section 10 below, and your continued use of the Site means you accept the updated Terms.
3. Using this website
You may use the Site for lawful purposes only. You agree not to:
- use the Site in any way that breaches any applicable local, national or international law or regulation;
- attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer or database connected to it;
- introduce any malware, viruses, or other material that is malicious or technologically harmful;
- reproduce, duplicate, copy or re-sell any part of the Site except as expressly permitted by these Terms.
We do not guarantee that the Site, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of the Site for business and operational reasons.
4. Our apps
Voss Labs publishes mobile applications, including Pookie, Paint Pals and Cardley (each an "App"), which are distributed through the Apple App Store. Your download and use of any App is additionally subject to:
- the terms, end-user licence agreement and privacy policy specific to that App, as presented within the App or on its App Store listing; and
- Apple's applicable terms of service, including the Apple Media Services Terms and Conditions and the standard Licensed Application End User Licence Agreement (EULA).
Where there is any conflict between these Terms and the terms specific to an App, the App-specific terms will prevail in respect of that App.
Apple is not a party to these Terms and is not responsible for the Apps or their content. Apple, the Apple logo and App Store are trademarks of Apple Inc.
5. Intellectual property
All intellectual property rights in the Site and in the material published on it (including the Voss Labs name and logo, app names, text, graphics and design) are owned by us or our licensors and are protected by copyright and other laws. You may view and print extracts of the Site for your own personal, non-commercial use, but you must not modify, reproduce or otherwise commercially exploit any part of the Site without our prior written permission.
6. Third-party links
The Site may contain links to third-party websites and services (for example, the Apple App Store). These links are provided for your convenience only. We have no control over, and accept no responsibility for, the content, privacy practices or availability of those third-party sites.
7. Disclaimers
The Site and its content are provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied, to the fullest extent permitted by law. While we make reasonable efforts to keep the information on the Site up to date, we make no representations or warranties that the content is accurate, complete or current.
8. Limitation of liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Subject to the above, we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with your use of, or inability to use, the Site, including any indirect or consequential loss. These Terms, their subject matter and their formation are governed by the laws of England & Wales. The courts of England & Wales will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, save that if you are a consumer resident elsewhere in the UK, you may also bring proceedings in your home jurisdiction.
